Reports taken by city police or a sheriff
Municipal police departments handle their own crash reports; Middletown PD, for example, takes requests with the report number, last name and date of incident and a $25 check or money order.
The form
Officers in Delaware write crash reports on the State of Delaware Uniform Traffic Collision Report. Most boxes on it hold numeric codes for things like contributing factors, injuries and road conditions.
When you must call the police
Immediately report to the police agency for the location if anyone is injured or killed, if the collision is on a public highway with apparent property damage of $2,000 or more, or if a driver appears impaired by alcohol or drugs (21 Del. C. 4203(a))
After you have the report
Delaware gives you two years to file a personal injury lawsuit (Del. Code tit. 10, § 8119). Every Delaware deadline and fault rule.
Delaware is an at-fault state: the driver who caused the crash, through their liability insurance, pays for the injuries and damage.
