From 2020 through 2024, 8,276 people died in 7,673 crashes on Georgia roads. That is 14.8 deaths a year for every 100,000 residents, above the US rate of 12.1, and the 16th highest rate of the 50 states and DC.

Fulton County had the most deaths (665). The road stretch with the most fatal crashes was I-285 (At Indian Creek Dr) in DeKalb County (78). In 2024, 1,403 people were killed, 15% fewer than in 2020.

  1. Get the crash report

    Statewide copies come from Georgia Department of Transportation (GDOT) crash reporting unit, sold online through the BuyCrash portal (LexisNexis); Georgia State Patrol reports are also available through the Department of Public Safety open records unit, cost GDOT mail-in request: $5 each, plus $2 for a certified report. The BuyCrash price is not stated on official pages read. and are usually ready GDOT mail requests take "at the least two weeks"; GDOT points people to BuyCrash for faster delivery.

  2. Know your deadline

    Georgia gives you two years to file a personal injury lawsuit (Ga. Code Ann. § 9-3-33). If a city, county or state vehicle was involved: A written ante litem notice of a tort claim against the State of Georgia must be given within 12 months of the date the loss was discovered or should have been discovered; claims against cities and counties have their own, shorter or different notice deadlines.

    Georgia is an at-fault state: the driver who caused the crash, through their liability insurance, pays for the injuries and damage.

  4. If you were partly at fault

    If you were partly at fault, your damages are reduced by your percentage of fault, but you recover nothing if you were 50% or more responsible. Georgia's 2025 tort reform law (SB 68) did not change this bar.
