Fatal car crashes in Virginia, county by county

From 2020 through 2024, 4,660 people died in 4,369 crashes on Virginia roads. That is 10.6 deaths a year for every 100,000 residents, below the US rate of 12.1, and the 33rd highest rate of the 50 states and DC.

Fairfax County had the most deaths (252). The road stretch with the most fatal crashes was US-1 (Richmond Hwy) in Fairfax County (23). In 2024, 917 people were killed, 8% more than in 2020.

After a crash in Virginia

  1. Get the crash report

    Local police do not sell reportable crash reports filed through TREDS; Fairfax County Police say all reportable crashes after May 1, 2017 are only available through Virginia DMV, while non-reportable crash reports (under $3,000, hit and run on public property) come from the police department.

  2. Know your deadline

    Virginia gives you two years to file a personal injury lawsuit (Va. Code Ann. § 8.01-243(A)). If a city, county or state vehicle was involved: A claim against a county, city or town for negligence is barred unless a written statement of the claim is filed within six months after the cause of action accrued (actual knowledge by the locality or its insurer can substitute); claims against the Commonwealth require a notice of claim within one year.

    Virginia is an at-fault state: the driver who caused the crash, through their liability insurance, pays for the injuries and damage.

  4. If you were partly at fault

    If you are even slightly at fault and your negligence contributed to the crash, Virginia bars you from recovering from the other driver (common-law rule; there is no comparative-fault statute).
