After a crash in Idaho

  1. Get the crash report

Statewide copies come from Idaho Transportation Department (ITD), Office of Highway Safety, cost $7.00 per report plus an Idaho.gov transaction fee and are usually ready "It will take a few weeks for a new report to become available online. It may take much longer depending on the law enforcement agency involved.".

How to get an Idaho crash report

  2. Know your deadline

Idaho gives you two years to file a personal injury lawsuit (Idaho Code § 5-219(4)). If a city, county or state vehicle was involved: Claims against the state (or a state employee) must be filed with the Secretary of State within 180 days from the date the claim arose or reasonably should have been discovered, whichever is later.

    Work out your date

  3. Who pays

Idaho is an at-fault state: the driver who caused the crash, through their liability insurance, pays for the injuries and damage.

  4. If you were partly at fault

If you were partly at fault, your damages are reduced by your percentage of fault, but you recover nothing unless your negligence was less than the other party's, so a 50% share bars recovery.

    The rule and its statute

  5. The other driver’s minimum coverage

The legal minimum liability coverage in Idaho is $25,000 per injured person, $50,000 per crash and $15,000 for property (25/50/15).
